Terms and Conditions

Layby Contract

Bright Buyz Ltd agrees to sell to you the goods selected on a layby instalment basis.  You agree to pay Bright Buyz Ltd for the goods by either Credit Card, Automatic Payment or Direct Debit, according to the payment schedule.  Manual payments must include the Contract No. as the reference on the Bank deposit form.  Failure to do so will incur bank tracing fees payable by you. You must pay all payments referred to in the payment schedule to get delivery of the goods.  You may pay up the total order value for the goods at an earlier date for early delivery of the goods.  You at any time can request a statement of the amount paid and left to pay for the goods ordered.

Age Limit

If you are under the age of 18 years, the application must be countersigned by a parent or person over the age of 18 as a joint buyer.

Order Cancellation

You may at any time cancel the order by notifying Bright Buyz Ltd.  Orders cancelled within 7 days will have all monies paid refunded.  Orders cancelled after 7 days will attract a cancellation charge to cover the selling costs of Bright Buyz Ltd being a minimum amount of $125 and maximum amount of 10% of the total order value of the goods.  After full payment for the goods no cancellation is possible.

Ownership

Ownership and possession of the goods will not pass to you until paid for in full.

Missed Payments

Where you miss a payment Bright Buyz Ltd will send you an updated payment schedule to reflect either increased payments to cover the missed payment, or a new final payment date.  This will be deemed an amendment to this agreement. If you miss 3 consecutive payments we will cancel your order and notify you, and Order Cancellation will apply.

Refusal of Layby

Bright Buyz Ltd may at its sole discretion, and without giving any reason, refuse layby or otherwise discontinue its trading with you.

Returns

Goods supplied by or for Bright Buyz Ltd cannot be returned or exchanged except under Product Supply/Substitution.

Product Supply and Substitution

Bright Buyz Ltd obtains the goods being sold from third party suppliers, and does not hold its own stock of such goods.  In the event the goods ordered under this agreement are, for any reason, not available for delivery to you on completion of the Layby payments, Bright Buyz Ltd will inform you of alternate products to be substituted.  You can either choose an alternate product or elect to receive a full refund of payments made.

Warranties

Bright Buyz Ltd will arrange with its supplier for the repair of any item that has been sold with a genuine manufacturing fault to the extent of the manufacturer warranty that is available with the goods.  If the item is not repairable it will be replaced where the manufacturer provides a replacement warranty.  Bright Buyz Ltd does not accept any responsibility for normal or excessive wear and tear.  The Consumer Guarantees Act 1993 applies to this agreement unless it is a business purchase.

Loss or Damage

Risk in the goods shall pass to you on receipt/delivery of the goods and you are then responsible for all loss of, or damage to, the goods however caused.

Waiver

Bright Buyz Ltd shall not be deemed to have waived any term unless such waiver shall be in writing under the signature of an authorised signatory of Bright Buyz Ltd.

Change of Address and Phone Number

You must advise Bright Buyz Ltd in writing or by phone within forty-eight (48) hours of any change of address or telephone number.

Privacy Act 1993

You irrevocably authorize Bright Buyz Ltd to collect, retain and use personal information about you (“Information”) including but not limited to the information contained in this agreement and information from third parties for the following purposes:

  1. Determining your on-going credit worthiness.
  2. Administration and enforcement of this agreement.
  3. Marketing goods and services provided by and on behalf of Bright Buyz Ltd and its partners.
  4. Conducting market research by and on behalf of Bright Buyz Ltd and its partners.

Disclosure

You irrevocably authorizes Bright Buyz Ltd to provide information:

  1. To employees and agents of Bright Buyz Ltd and any other person, in the course of business, for any of the purposes noted under Privacy Act 1993.
  2. To credit agencies and other suppliers of goods and services.
  3. To Bright Buyz Ltd and any other person to whom Bright Buyz Ltd may assign any part of its business.

You are entitled to access the personal information held and to have any inaccuracy corrected.
